Copyright takedown notices should be sent to Profitory’s designated agent:

This agent is registered with the United States Copyright Office under the alternate names “Profitory” and “profitory.app”.

To be effective, your written notice to the designated agent above must include substantially the following:

• Your name and contact information (address, telephone number, and email address).
• Identification of the copyrighted work you claim has been infringed.
• Identification of the material that you claim is infringing, and information reasonably sufficient to let us locate it on the Services.
• A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in your notice is accurate, and — under penalty of perjury — that you are the copyright owner or are authorized to act on the owner’s behalf.
• Your physical or electronic signature.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages. If you are unsure whether the material is protected by copyright, we recommend that you contact an attorney before filing a notice.

If your own material was removed from Profitory as a result of a mistake or misidentification, you may send a written counter notification to the designated agent above. To be effective under the DMCA, it must include substantially the following:

• Identification of the material that was removed or disabled, and where it appeared before it was removed.
• A statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located, or — if your address is outside the United States — any judicial district in which we are located.
• A statement that you will accept service of process from the party who filed the notice, or that party’s agent.
• Your name, address, and telephone number.
• A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of a mistake or misidentification.
• Your physical or electronic signature.

On receiving a valid counter notification we will restore the material, unless the party who filed the original notice first informs us that they have filed a court action to restrain the activity in question. Filing a false counter notification constitutes perjury, and materially misrepresenting that material was removed by mistake may make you liable for damages, including costs and legal fees.
